In October 2002, plaintiff John W. Grace began receiving treatment for an eye condition at the Veteran's Administration Rochester Outpatient Clinic (VA Clinic) from ophthalmologist Dr. Shoba Boghani. Plaintiff's July 2003 appointment with her, however, was cancelled and not rescheduled for approximately one year. When plaintiff returned in August 2004, another VA ophthalmologist scheduled a consultation for plaintiff with Rochester Eye Associates. During that appointment, plaintiff was diagnosed with neovascular glaucoma, which ultimately left him blind in his right eye. At some point, plaintiff apparently learned that his blindness may have been prevented had it been detected earlier.</div>

In June 2006, plaintiff retained Robert L. Brenna, Jr. and Brenna, Brenna & Boyce, PLLC (the Brenna defendants), to bring an administrative proceeding against the Veteran's Administration (the VA) for malpractice due to its alleged failure to diagnose the eye condition and follow up with plaintiff after the VA canceled his July 2003 appointment. When delays occurred in the proceeding that the Brenna defendants brought on plaintiff's behalf, they recommended that plaintiff retain Michael R. Law and Phillips Lytle LLP (the Law defendants)</div>

In January 2008, plaintiff, represented by the Law defendants, filed an action in federal court against the United States and the VA under the Federal Tort Claims Act for medical malpractice and negligence in cancelling his July 2003 appointment (hereinafter the underlying action). At some point, the Law defendants learned that Dr. Boghani was not employed by the VA but was instead an employee of the University of Rochester (University), one of their existing clients. Because of this conflict, they informed plaintiff that they could no longer represent him. The Brenna defendants resumed representation of plaintiff. On December 8, 2008, an order was signed by the District Court, directing the substitution of counsel.</div>

The VA was granted leave to commence a third-party action against Dr. Boghani and the University. Plaintiff amended his complaint to add Dr. Boghani and the University as defendants. Dr. Boghani and the University moved for summary judgment dismissing the claims against them as time-barred. The VA also moved for summary judgment based upon lack of jurisdiction, alleging that it was not liable to plaintiff because Dr. Boghani was not its employee.</div>

Holding that plaintiff's claims against Dr. Boghani and the University were time-barred, the United States District Court for the Western District of New York granted defendants' motion for summary judgment (see Grace v. United States, 754 F Supp 2d</div>

The court determined that Dr. Bohgani was an independent contractor, not an employee of the VA, and thus, jurisdiction was lacking for plaintiff's claim that it was liable for Dr. Boghani's actions. The court granted the VA's motion for summary judgment to that extent (see id. at 597-598). Plaintiff's remaining claim for malpractice based on the VA's failure to reschedule his appointment, however, survived the VA's motion.</div>

Thereafter, Brenna sent plaintiff a letter which stated that plaintiff was unlikely to succeed on the remaining claim against the VA, and that a trial on that claim would be lengthy and, due to expert costs, expensive. Plaintiff thus directed the Brenna defendants to discontinue the underlying action.</div>

Subsequently, plaintiff retained his current counsel to sue the Brenna defendants and the Law defendants for legal malpractice in failing to timely sue Dr. Boghani and the University. The Law defendants answered that plaintiff was estopped from commencing this action because he failed to appeal the underlying action. They later moved for leave to amend their answer to assert a statute of limitations defense, and upon amendment, for summary judgment in their favor, dismissing the complaint. The Brenna defendants also moved for summary judgment. They argued that plaintiff voluntarily discontinued the underlying action, thus forfeiting any right he may have had to pursue this legal malpractice action, and that they were not</div>

Supreme Court granted the Law defendants' motion to amend their answer, denied their motion for summary judgment, and denied the Brenna defendants' motion for summary judgment. Both defendants appealed.</div>

The Appellate Division, with one justice dissenting, affirmed the Supreme Court order (Grace v. Law, 108 AD3d 1173 [4th Dept 2013]). The court observed that while this is an issue of first impression in New York, a per se rule that failure to appeal in an underlying action bars a legal malpractice claim has been rejected by several of our sister states. The court concluded that "defendants failed to establish that plaintiff was likely to succeed on appeal…and, therefore, that their alleged negligence was not a proximate cause of his damages" (id. at 1176). The court determined that the record was insufficient to hold that defendants' "representation of plaintiff did not preclude him from prevailing in the underlying lawsuit or upon appeal" (id.). In denying the Law defendants' motion for summary judgment, the court held that "the continuous representation doctrine applied to toll the statute of limitations" (id. at 1177).<sup style="border: 0px; font-size: 14px; font: inherit; line-height: 0; margin: 0px; padding: 0px; position: relative; top: -0.5em; vertical-align: baseline;">1</sup></div>

While this Court has not had occasion to enunciate the appropriate standard for bringing legal malpractice lawsuits in the circumstances presented here, the Appellate Division Departments have examined similar circumstances (see Rupert v. Gates & Adams, P.C., 83 AD3d 1393 [4th Dept 2011]; Rodriguez v. Fredericks, 213 AD2d 176 [1st Dept 1995]). Those decisions -- presented in the settlement context -- generally stand for the proposition that an attorney should be given the opportunity to vindicate him or herself on appeal of an underlying action prior to being subjected to a legal malpractice suit.</div>
<div style="border: 0px; box-sizing: border-box; font: inherit; padding: 0px 0px 10.366666793823242px; vertical-align: baseline;">
Defendants contend that a plaintiff forfeits his or her opportunity to commence a legal malpractice action when he or she fails to pursue a nonfrivolous or meritorious appeal that a reasonable lawyer would pursue (see Sands v. State of New York, 49 AD3d 444, 444 [1st Dept 2008]; see also MB Indus., LLC v. CNA Ins. Co., 74 So 3d 1173 [LA 2011]; Rondeno v. Law Office of William J. Vincent, 111 So 3d 515, 524 [LA 4th CCA 2013]). In contrast, plaintiff urges us to adopt a "likely to succeed" standard.</div>

Courts applying the "likely to succeed" standard analyze whether a client can commence a legal malpractice action without taking an appeal in the underlying action based upon the likelihood of success on that underlying appeal. In Hewitt v. Allen (118 Nev 216 [Nev 2002]), the Supreme Court of Nevada held that the voluntary dismissal of an underlying appeal does not constitute abandonment where the appeal "would be fruitless or without merit" (id. at 216). The United States District Court for the District of Nevada interpreted Hewitt to mean that a defendant would have to show that the pending appeal was "likely" to succeed (U-Haul Co. of Nevada, Inc. v. Gregory J. Kramer, Ltd., 2013 WL 4505800, at *2 [D. Nev. 2013]). Florida courts have held that "[w]here a party's loss results from judicial error occasioned by the attorney's curable, nonprejudicial mistake in the conduct of the litigation, and the error would most likely have been corrected on appeal, the cause of action for legal malpractice is abandoned if a final appellate decision is not obtained" (Segall v. Segall, 632 So 2d 76, 78 [Fla 2d DCA 1993]; see Technical Packaging, Inc. v. Hanchett, 990 So 2d 309, 316 [Fla 2d DCA 2008]; Eastman v. Flor-Ohio, Ltd., 744 So 2d 499, 504 [Fla 5th DCA 1999]).</div>

Defendants argue that the "likely to succeed" standard should not be adopted because it requires courts to speculate on the outcome of the underlying appeal. They posit, nevertheless, that even were we to adopt the "likely to succeed" standard,</div>

Here, the Appellate Division adopted the likely to succeed standard employed by our sister states with a proximate cause element.<sup style="border: 0px; font-size: 14px; font: inherit; line-height: 0; margin: 0px; padding: 0px; position: relative; top: -0.5em; vertical-align: baseline;">2</sup> We agree that this is the proper standard, and that prior to commencing a legal malpractice action, a party who is likely to succeed on appeal of the underlying action should be required to press an appeal. However, if the client is not likely to succeed, he or she may bring a legal malpractice action without first pursuing an appeal of the underlying action.</div>
<div style="border: 0px; box-sizing: border-box; font: inherit; padding: 0px 0px 10.366666793823242px; vertical-align: baseline;">
On balance, the likely to succeed standard is the most efficient and fair for all parties. This standard will obviate premature legal malpractice actions by allowing the appellate courts to correct any trial court error and allow attorneys to avoid unnecessary malpractice lawsuits by being given the opportunity to rectify their clients' unfavorable result. Contrary to defendants' assertion that this standard will require courts to speculate on the success of an appeal, courts engage in this type of analysis when deciding legal malpractice actions generally (see Davis v. Klein, 88 NY2d 1008, 1009-1010 [1996] ["In order to establish a prima facie case of legal malpractice, a plaintiff must demonstrate that the plaintiff would have</div>

Forsyth & Forsyth, 280 AD2d 79, 82 [4th Dept 2001]). We reject the nonfrivolous/meritorious appeal standard proposed by defendants as that would require virtually any client to pursue an appeal prior to suing for legal malpractice.</div>

Applying the likely to succeed standard to the merits of this case, the Appellate Division reached the correct result.</div>
<div style="border: 0px; box-sizing: border-box; font: inherit; padding: 0px 0px 10.366666793823242px; vertical-align: baseline;">
On this record, defendants failed to provide sufficient evidence to determine that plaintiff would have been successful on appeal in demonstrating that Dr. Boghani was a VA employee, rather than an independent contractor counsel was required to name as a defendant separate from the VA (see Lone v. United States, 910 F2d 46, 50 [2d Cir 1990], cert denied 499 US 95 [1991]; see also United States v. Orleans, 425 US 807, 813 [1976]). As support, defendants submitted the contract between the VA and the University, which indicates, among other things, that Dr. Boghani was required to work at the VA Clinic six days per month, was under the general direction of the VA, and the University paid Dr. Boghani's salary but was reimbursed by the VA. This information is insufficient to definitively determine whether Dr. Boghani was a VA employee, and thus, the Appellate</div>

Regarding the Law defendants' motion for summary judgment on the ground that plaintiff's claims against them are time-barred, the statute of limitations in a legal malpractice action is three years from the accrual of the claim (see CPLR §214). Plaintiff commenced this action on December 5, 2011. The Law defendants claim that plaintiff should have known as early as September 26, 2008, that they would no longer be able to represent him and that the Brenna defendants would be taking over the case. Plaintiff, however, claims that he did not learn of the substitution of counsel until December 8, 2008, when the official stipulated order substituting counsel was issued by the District Court.</div>

"[T]he rule of continuous representation tolls the running of the [s]tatute of [l]imitations on the malpractice claim until the ongoing representation is completed" (Shumsky v. Plaintiff has raised a triable issue of fact as to whether the doctrine of continuous representation tolled the statute of limitations because it is unclear when the Law defendants' representation of plaintiff ended. Therefore, the Appellate Division properly denied the Law defendants' motion for summary judgment based on the statute of limitations.</div>

What does an attorney do to avoid being the subject of a malpractice served as a defensive counter claim to an attorney's action to recover on an unpaid account?<br />
<br />
There is no simple answer.<br />
<br />
Beyond initial inquiry into the financial ability of a client when an initial engagement retainer is being prepared, and beyond being certain that a client is regularly and properly informed of the work as it is in progress there is no "fail-safe" mechanism to prevent the former clients from filing a counter claim allegation that the services rendered proximately caused the client pecuniary damage to the client.<br />
<br />
The writer makes many time honored suggestions for the practitioner to keep in mind in the management of client account receivables. Each suggestion has a place to consider.<br />
<br />
The suggestions are really trademarks of good client management and good business practice which are mandated - and necessary in the area where the "services" are often critical in commercial business decisions - but also these suggestions are very important to clients whose concerns are not in the commercial areas of the law. <br />
<br />
Each class of clientele requires an attorney to provide not only competent legal services, but competent communication of what has been done for the client, and the time and costs to do so. <br />
<br />
It is a process of communicating to the client what is being done, when it is being done, and the lawyer standing ready to be responsive to clients inquires as the work is in progress that will lessen the client's use of a counterclaim to a non payment action.<br />
<br />
If an attorney regularly invoices a client for services rendered, but the client stands mute, the attorney has performed the critical communication link and prima facie established a right to payment under a theory of law recognized to be an "account stated" - but even good bookkeeping, and client communication is not a guarantee that issues of malpractice will not surface.<br />
<br />
The article outlines some of the helpful hints so as to avoid defensive counterclaims. None are guarantees that defensive malpractice fee suits will not be filed and the article discusses the mandatory rules for fee collections being governed by mandatary fee dispute mediation and the differing statute of limitations provisions for a legal malpractice claim, (three years) as compared to the statute of limitations for te enforcement of a retainer contract ( six years). <br />

</span>Section 487 of the Judiciary Law permits the imposition of punitive damages when the actions complained demonstrate the attorney committed a deceit either upon the Court, or any party, in a pending action. <br />
<br />
Generally conduct which is deceitful is criminal in nature - hence punitive damages are awarded separate from compensatory damages. <br />
<br />
Punitive damages are awarded as part of the purpose of penal law which is to penalize. Civil law damages are intended to be compensatory for the loss suffered without inquiry necessarily into the intent which caused the damages.<br />
<br />
<b><br />
Judiciary Law § 487 "descends from the first Statute of Westminster, which was adopted by the Parliament summoned by King Edward I of England in 1275." </b>(<i>See Amalfitano v Rosenberg, </i>12 NY3d 8, 12 [2009].) The statute reads in its entirety: <br />

"A violation of Judiciary Law § 487 (1) may be established either by the defendant's alleged deceit or by an alleged chronic, extreme pattern of legal delinquency by the defendant'." <br />
</b>(<i>Boglia v Greenberg</i>, 63 AD3d 973, 975 [2d Dept 2009] and the opinion by the Court of Appeals discussed the origin of this rule of law in New York.as being traced to "the first Statute of Westminster...in 1275" and the Court found that " a cause of action for attorney deceit ...exists asa prat of New York 's common law before the first New York statute governing attorney deceit was enacted in 1787" and as such are subject to a six year statute of limitations and not a three year statute.<br />
<br />
This decision did not delve into the interpretation of the statute but rather the application in terms of determining the timeliness of enforcement.<br />
<br />
In the case before the Court of Appeals it was noted that initially the motion court had denied the defendant attorney motion to dismiss the claims as Defendants claimed the action was time barred because the action had not been filed within three years of the claimed event.<br />
<br />
On appeal the intermediate appellate court reversed that order and granted the defendant's Morton and dismissed the complaint finding that the action was time barred as it was not filed within three years of the claimed event, but on appeal to the Court of Appeals the complaint was restored - the order of the Appellate Court reversed, and the matter remanded to the motion court to proceed because the application of the statute was determined to be governed by a six year statute. <br />
<br />
The decision made no comment on the sufficiency of the claims of either party, at this stage of the matter, because the order of the Court of Appeals applies to the procedural aspect of the case and nothing further. <br />
<br />
The net effect is that the case is returned to the motion court for the parties to continue with discovery and such other and further remedies as may be then available to each party, but the order is significant because it clarified the time limitations within which such claims may be filed. `<br />
<br />
The seemingly disposal of this case now is revived and so to speak, rises again to begin anew, but in the wake of that journey this case has left a "trail mark" decision on this issue for others to be guided accordingly.<br />

"Oral Agreement Unenforceable, Barred By Parol Evidence Rule; Firm Awarded Claim"</i><span style="font-size: medium;">

is the caption on a brief article appearing in the NYLJ on March 20, 2014 and the focal point of this article comes from a discussion of a recently decided case coming from the District Court of Nassau County in a dispute for the non payment of legal fees.<br />
<br />
At issue is the non enforcement of a claimed prior oral agreement by the client to have been made to limit fees, but admittedly as superceded by a subsequent written agreement executed by the parties which made no mention of any prior agreements as the client alleged.<br />
<br />
The law firm sued the former client for non-payment of legal fees in a matrimonial matter. In defending the action the former client alleged the existence of an oral agreement to cap legal fees at $6,000.00. <br />
<br />
The law firm denied the same and referred to the express terms of the written retain which did not provide for a cap on legal. The client did not deny having signed the written retainer which made no mention of any prior oral agreement, but defended the claim on the basis of a prior oral agreement limiting the fees to be charged.<br />
<br />
The Court relied on the application of Parole Evidence Doctrine precluding the introduction any evidence which would contradict the express terms of the written retainer because the terms of the written retainer were complete and not ambiguous , AND explicitly provided in the written retainer that "no other" agreements or terms that were effective other than what was provided for in the written retainer. <br />
<br />
Caveat - read what you say you have read before you sign the document which states that is exactly what you are doing. <br />

<br />
From a procedural perspective - even if factually demonstrated at a subsequent stage of the litigation to be without support, the appearance of that posture will operate as a hurdle not capable of resolution without a trial on the issues.<br />
<br />
A Manhattan judge has refused to dismiss a legal malpractice suit against a prominent KIngs County firm thereby mandating that the resolution of that issue had to be decided at a trial of the matter as the submissions before the motion court were not sufficient to resolve the issue in a case in which it was alleged that the law firm had a conflict of interest by representing two parties in a dispute among siblings that resulted in damages to the plaintiffs. <br />
<br />
The Court in that case ruled that <br />
<br />
"a conflict of interest as a result of dual representation of clients in violation of professional responsibility rules, does not alone support a legal malpractice claim. But liability can follow when the client proves actual damages as a result of the conflict." <br />
<br />
In denying the motion by the law firm to dismiss the Court found that the former clients could maintain a legal malpractice could proceed based on the allegations that the law firm used their dual representation to aid and abet one client against another and the aiding and abetting causes of action plead sufficient allegations that the law firm knowingly gave advice in violation of an apparent conflict of interest.<br />
<br />
It is said that "no man can serve two masters." - and this continues to be the cornerstone to this prohibition because in a dual representation situation, advising one client may result in injury to another, and in rendering advise in that circumstance would then open a lawyer up to liability<br />
<br />
In fact even when clients are given proper notice that a dual representation situation occurs, and the client(s) want to consent to continued represenation, the attorney may no longer be able to provide adequate representation and there may be no alternatifve other than calling for the attorney to withdraw in toto. <br />
<br />
In the case under discussioin the defendant's application to dismiss could not be granted, at this procedural posture of the case, because of the outstanding issues of fact undecided at the motion stage of the litigation. <br />
<br />
This posture could have been avoided.<br />

A client has a right to reasonably demand that the explicit and implicit represenations of the attorney are materially correctly stated so that an informed consent to retain the attorney or law firm is properly made. <br />
<br />
But what happens when a client materially makes a false statement to induce the attorney to accept the engagement of work being requested by the client?<br />
<br />
Well a recent published case suggests a remedy exists and is published today in the <strong>New York Law Journal </strong>(February 28, 2014 see pages 1 col 5-6 and page 8 col 1-4) This case currently is pending in Supreme Court New York County and the headline reads <br />

After its former client sued the firm for malpractice, Proskauer Rose and four of its partners have sued the client's senior executives, claiming they solicited legal advice based on "materially false...representations" and have harmed the firm's reputation with their "meritless" claims. </dir>

The heart of the New York Law Journal’s analysis of Proskauer’s claims is found in the following paragraphs:<br />

In May 2011, Proskauer provided Edelson and Itkin with a first draft of its memo, which argued that available evidence supported that the parties had not intended to make the OIN subsidiary a guarantor of OSG, according to the firm. In follow-up discussions, Edelson and Itkin did not suggest to Proskauer that the argument's premises were false, the suit said. [emphasis added].<br />
According to Proskauer, Edelson "knowingly deceived" the firm into drafting the memo, "in an attempt to disguise OSG's enormous tax problem while the company was in the midst of a financially uncertain situation." [emphasis added]. </dir>

Proskauer’s claim appears to be that its former client made "materially false and misleading representations" to it during the term of its representation. <br />

It is then alleged that in the absence of truthful representations concerning its ex-client’s circumstances, Proskauer was unable to provide adequate representation. <br />
<br />
The lack of client information led to inadequate representation that ultimately harmed the ex-client’s interests. Proskauer was sued for legal malpractice, but successfully defended the legal malpractice claims at substantial econmic costs and damages to it's reputation. <br />
<br />
While the extract from this published article may be that a retainer agreement should include all material facts, i.e., true facts, provided by a client, upon which an attorney is intended to rely upon during the course of the representation the journey is a two way street calling not only for disclosure by a client, but reliance by a client on the material represntations made by the attorney or law firm inducing the execution of the retainer agreement as well. <br />

Is it reasonable to demand that a client (and an attorney) must provide all facts related to thei legal issue in order for their attorney to adequately represent and protect their interest - and the attorney or law firm must be required to represent the skills and wherewithall necessary to perform the work required to be done as such matters are material disclosures which should be required in every agreement between an attorney and client. <br />

Generally a claim for legal malpractice commences when the malfeasance is committed and an action to recover must be filed within three years of that event.<br />
<br />
But if the attorney continues to represent the client on that matter the three year statute would not commence until the time when the attorney client relatonship ceases. It is from that time when the three year statute would begin to run.<br />
<br />
Sometimes the malfesance is concealed by the attorney. <br />
<br />
When an attorney conceals the errors of malfeasance the three year statute of limitations would not begin to run in such facts of malfeasance are disclosed.<br />
<br />
The fact that the attorney client relationship ceased would not be a bar to the three year statute of limitations if the material facts are concealed from the client by the attorney. The time limitation would not run until the time of discovery of the concealment.<br />
<br />
But what about a client who has been conconvicted of a crime and sentenced. <br />
<br />
If an attorney commits an error in representing an individual in a criminal cases which results in the wrongful conviction of the client the time within which to proceed to recover damages for the negligent actions is not limited to three years.<br />
<br />
If the judgment of conviction is reversed - the malfeasance of the defense attorney is not shielded by a three year statute. <br />
<br />
The time to commence a claim for legal malpractice arises at the time when the <br />
judgment of conviction is reversed. <br />
<br />
And that is as it should be for to do otherwise would be to perpectrate an unjust result for to an individual who was otherwise innocent "but for" the malfeasance of the attorney whose errors proximately caused an unlawful confiction. <br />

The road to recovery in a criminal legal malpractice action is not an easy road to travel, but a time limitation created at the time when the judgment of conviction is vacated creates a window permitting an action to proceed.<br />

The duty to disclose the attorney's failure to properly represent a client is an obligation which must be performed by every attorney who is faced with the task of informing their client that as a proximate result of their failure to perform they have failed the client and caused damage..<br />

When a lawyer causes a client financial damage which is proximately resulting from their performance - that attorney continues to have a duty to inform the client of that error - and that attorney must advise the client to seek legal advise.<br />
<br />
Contemporaneous with the moment the attorney discovers the error a conflict arises because when the error is discovered - the attorney then knows that his client has a potential claim againt the lawyer thereby creating a conflict of interest. <br />
<br />
While painful to the attorney to discover that they have caused a client damage it is ethically required that the attorney communicate the sane to the client and advise the client of their rights on how to proceed should the client so decide to do so. <br />
<br />
This obligation to communicate by the attorney should be communicated in a direct manner contemporaneously with the time of discovery and the attorney is well advised to be sure that they have performed their obigations leaving no doubt that the client has been notified.<br />
<br />
Simple as this sounds the mandatory task is sometimes neglected.<br />
<br />
In rare instances an attorney may attempt to concealed the error - but concelment will not immunize the attorney. Generally - although the time to file a claim for Legal Malpractice is limited to three years from the time of the occurance or three years from the last day when an attorney client relationship existed, but when the attorney has concealed the error from their client <br />
that concealment by the attorney will not bar the client from proceeding upon discovery of the concealment, because an attorney owes a duty of disclosure of these errors to their client when they become known.<br />

The notion that we should <a href="http://www.salvanlawfirm.com/">sue all the lawyers</a> has been around for a long time, but in the last 20 years the practice area of legal malpractice has greatly increased.<br />
<br />
And at the end of the day - when desired results are not obtained, it is now not an uncommon consideration that "when all else fails" consideration shifts to the option of bringing a civil action against the very same person(s) who you once trusted and confided in to bring you desired results.<br />
<br />
It is no longer an isolated action - it is a common place event and occurrence of daily litigation to find legal malpractice actions filed not only in New York City, but everywhere and anywhere a courthouse is located.<br />
<br />
After all - even the best attorneys make mistakes!<br />
<br />
But the option of bringing a lawsuit against an attorney requires more than the opportunity for vented anger of revenge to succeed - and the fact remains that while everyone can make a mistake not every negligent acttion by an attorney will constitute a claim for legal malpractice. <br />
<br />
Lawyers are not insurer!<br />
<br />
Lawyers can make a mistake of judgment - and they can be negligent but the negligent action may not be the cause of the harm.<br />
<br />
To constitute a claim for <a href="http://www.salvanlawfirm.com/Practice-areas-overview/Legal-malpractice.shtml">legal malpractice</a> the individual or entity who files the action must initially have had an attorney client relationship.<br />
<br />
The attorney - or law firm, must have had a duty which was not executed consistent with good and accepted practice which is a cause of pecuniary loss.<br />
<br />
Said another way - the conduct complained of must be capable of being proven that "but for" the claimed error you would have not been damaged. <br />
<br />
And that omission must be a proximate cause of your damage.<br />
<br />
And the claim must be filed within 3 years of the time when the claimed omission took place or within 3 years after the last date when the attorney or lawfirm performed services to the client in reference to the specific transaction which is the subject of the legal malpractice claim.<br />
<br />
And while this sounds simple in concept, arriving at a successful result - often is not that easy to do because in the defense of such claims it if is possible to demonstrate that any one of the elements cannot be proven, the action will fail.<br />
<br />
This purpose of this blog will to provide general information about this interesting pracrtice area of the law so that the issues are better understood and to present a discussion on emerging issues.<br />
